on the CLJA: At the eleventh hour, the House of Representatives stopped
the expected vote on the PACT Act yesterday by issuing a “blue slip.” A
blue slip is a procedural challenge to a bill when the bill
“originates” in the wrong Chamber. Any bill with a provision relating to
revenue must originate in the House. In this case, when the Senate
passed its version of the PACT Act, it added a revenue provision that
had not been included in the House version. </div><div dir="auto" style="text-align: start;"> </div><div dir="auto" style="text-align: start;">The House noticed the
revenue provision at the last minute and pulled the bill from the floor
schedule—so there was no vote, and none is anticipated on the bill, as
it stands, any time soon. Instead, the Senate must take up the bill
again to strip the revenue provision and get it back to the House
without the problematic provision. The easiest way to do this would be
for Senator Schumer to request and obtain unanimous consent from the
Senate. </div><div dir="auto" style="text-align: start;"> </div><div dir="auto" style="text-align: start;">While possible, such consent is extremely unlikely given that it
takes only one Senator to object to break unanimity. That means that
the Senate will almost certainly need to go through a full round of
votes to take the revenue provision out, and then send the bill back to
the House for a vote. Alternatively, the House could pass a new bill
with the revenue provision in it, and send that bill back to the Senate.
But under those circumstances, too, the Senate will need to go through a
full round of votes to pass the bill. </div><div dir="auto" style="text-align: start;"> </div><div dir="auto" style="text-align: start;">Because there are only two days
left before the Senate goes home for two weeks (until July 11), there
will likely be no action until mid-July at the earliest. Action in the
Senate is also dependent on Leadership’s willingness to devote another
week—or more—of floor time to the bill, which is still uncertain.
Standard caveat with all things Congress: Everything is fluid and things
can change on a dime.</div><div dir="auto" style="text-align: start;"> </div><div dir="auto" style="text-align: start;">I will update again when new information comes out. <br /></div></div></span></span></div>Unknownnoreply@blogger.com0tag:blogger.com,1999:blog-8661563496305009929.post-87925221891530878612022-06-16T12:29:00.004-05:002022-06-16T12:29:59.687-05:00PACT ACT Passes the Senate!<p><span style="font-size: medium;">Good news!!</span></p><p><span style="font-size: medium;">Today the Senate passed the PACT ACT by a vote of 84/14!</span></p><p><span style="font-size: medium;">I appreciate all the help everyone put in to get us to this day. </span></p><p><span style="font-size: medium;">Please be sure to thank your Senators for keeping their promise to our Veterans.</span></p><p><span style="font-size: medium;">It's a historic day for Veterans and their families! Attorney Ed Bell with an update on the water contamination at Camp Lejeune and
the PACT ACT.</span></p><p><span style="font-size: large;"> <i>UPDATE ON THE CAMP LEJEUNE JUSTICE ACT!! A few weeks ago, the Department of
Justice wanted to remove the Camp Lejeune Justice Act from the PACT Act and
propose a $50,000 "No Fault" settlement. Many of us sent numerous emails and
made phone calls to the White House, the Department of Justice, and our
Senators opposing this. </i></span></p><p><span style="font-size: large;"><i>We received news today that the Department of Justice
has backed down and the Camp Lejeune Justice Act will stay in the Pact Act.
The House passed the PACT Act in March. Both parties reached an agreement and
it is expected to be voted on in the next 2-3 weeks, passed, and signed into
law. </i></span></p><p><span style="font-size: large;"><i><b>What does this mean for Camp Lejeune Victims?</b> It will allow for personal
injury and wrongful death suits. All of us affected by this toxic nightmare
have been through hell and back, but this is great news and we may finally see
justice. #justiceforcamplejeunevictims</i></span></p><p><span style="font-size: large;"><i> </i>
There are countless lawyers already clamoring to get your money, however Mr. Bell
and his firm have been with this issue from the beginning and have already in
place experts and all the information on the water to help the cases go forward
more quickly. It is a good idea to call and register with them. This includes
for your deceased family members, lost children, stillborns and other
reproductive issues. Kidneys, cancers, or related issues. Heart, lungs, the list
goes on. Any and all issues you have physically struggled with may be eligible
for medical care and or compensation. </span></p><p><span style="font-size: large;"> It is my understanding the attorney will
be looking at each of us on a case by case basis. Should they find groups of
illnesses they may lump them together. Their fees range from 1/3 to 40% of any
settlement you may receive. Those will be determined by the attorney and you. </span></p><p><span style="font-size: large;">To
reach Bell Legal Group - Patti Mobley -Very knowledgeable! Please call
1-843-546-2408 Or 1-833-Lejeune </span></p><p><span style="font-size: large;">I encourage everyone to contact them, talk to
them about your medical issues, regardless of how small or insignificant you may
think they are. And keep in mind, you may not have issues today, but you could
next year and in ten years. There is a 2 year limit in order to file a claim. In
2-3 weeks the Senate will be voting, keep encouraging them and thanking them for
helping the Veterans, families and civilians that have suffered all these years
from Camp Lejeune. We have hope! </span></p><p><span style="font-size: large;"> </span></p><p><span style="font-size: large;">Also, since this has come about, all hands on
deck are asked to stand down. Brian Amburgey -FB Moderator ATTENTION ON DECK IF
YOU ARE HOLDING A OUTREACH AWARENESS DAY TOMORROW PLEASE STAND DOWN . PLEASE
FEEL TO CONTACT Brian FOR MORE DETAILS

Department of Justice has decided they want to offer all of the
Veterans and families who were at Camp Lejeune a whopping $50,000
settlement compensation per family member. They would like us to be
included in a Federal Tort claim. The 2015 SCOTUS CTS Corp V Waldburger
decision blocked all federal tort claims but the PACT Act would remove
those blocks.</span></span></span></p><p><span style="font-size: medium;"><span style="color: black;"><span style="font-family: georgia;">The Pact Act is going before The US Senate directly and they will be taking a vote on whether or not they will pass this.</span></span></span></p><p><span style="font-family: georgia;"><span style="font-size: medium;"><span style="color: black;">It is highly important to contact your State's Senators and the White House to get the Pact Act passed.</span></span><br /></span></p><p><span style="font-family: georgia;"><span style="color: red;">~~~ <span style="font-size: medium;"><b>My Notes from the meeting and links to explore for more information</b></span></span><br /></span></p><div id="m_588675563947960324m_-5663939401302642456gmail-:2rc" style="display: block;"><div aria-controls=":2ut" aria-label="Message Body" aria-multiline="true" id="m_588675563947960324m_-5663939401302642456gmail-:2r8" role="textbox" style="direction: ltr; min-height: 291px;"><div class="gmail_default" style="color: #4c1130;"><span style="font-family: georgia;"><a data-saferedirecturl="https://www.google.com/url?q=https://www.congress.gov/bill/117th-congress/house-bill/3967&source=gmail&ust=1652053379049000&usg=AOvVaw0sMfnm2bySQnMlNSs5FvkS" href="https://www.congress.gov/bill/117th-congress/house-bill/3967" target="_blank">https://www.congress.gov/bill/<wbr></wbr>117th-congress/house-bill/3967</a></span></div><div class="gmail_default" style="color: #4c1130;"><span style="font-family: georgia;"><br /></span></div><div class="gmail_default" style="color: #4c1130;"><h1 style="text-align: left;">

<p><span style="font-family: georgia;"><b>Honoring our Promise to Address Comprehensive Toxics Act of 2021 or the Honoring our PACT Act of 2021</b></span></p> <p><span style="font-family: georgia;">This
bill addresses health care, presumption of service-connection,
research, resources, and other matters related to veterans who were
exposed to toxic substances during military service.</span></p> <p><span style="font-family: georgia;">The bill
provides eligibility for Department of Veterans Affairs (VA) medical
care, including mental health services and counseling, to veterans who
(1) participated in a toxic exposure risk activity (a qualifying
activity that requires a corresponding entry in an exposure tracking
record system), (2) served in specified locations on specified dates, or
(3) deployed in support of a specified contingency operation.</span></p> <p><span style="font-family: georgia;">The
bill establishes the Formal Advisory Committee on Toxic Exposure to

presumptions of service-connection.</span></p> <p><span style="font-family: georgia;">The bill modifies or
establishes the presumption of service-connection for certain conditions
or purposes for various groups of veterans. </span></p> <p><span style="font-family: georgia;">Among other requirements, the VA must</span></p><ul><li><span style="font-family: georgia;">provide
a veteran with a medical examination regarding the nexus between a
disability and toxic exposure risk activity if a veteran submits a
disability compensation claim for a service-connected disability with
insufficient evidence,</span></li><li><span style="font-family: georgia;">incorporate a clinical questionnaire to
help determine potential toxic exposures as part of the initial
screening conducted for veterans with a VA primary care provider, and </span></li><li><span style="font-family: georgia;">establish
a registry for current or past members of the Armed Forces who may have
been exposed to per- and polyfluoroalkyl substances due to the
environmental release of aqueous film-forming foam at a Department of
Defense location. </span></li></ul>

I'm sorry that I missed the Zoom meeting today. I made a lot of calls
last week. This afternoon an aide from Senator Tillis's office
returned my call, which I appreciated. I asked what progress the Camp
Lejeune Justice Act was making in the Judiciary Committee and I was told
to go to the Congress.gov website. I asked if, when this bill goes to
the Senate floor, will it be it be a stand alone bill or part of a
bigger package? Again, I was referred to the website. I was told though
that there are two more Senators leaning our way, so that is welcome
news. I'm surprised that Senator Tillis's office didn't have any other
relevant information to pass along at this time.</span></span></span></span></div><div class="gmail_default" style="color: #4c1130;"><span style="font-family: georgia;"><span dir="auto" lang="en"><span dir="auto"> </span></span></span></div></div><div aria-controls=":2ut" aria-label="Message Body" aria-multiline="true" id="m_588675563947960324m_-5663939401302642456gmail-:2r8" role="textbox" style="direction: ltr; min-height: 291px;"><span style="font-size: medium;">Note: On
one hand, at least <i><u>the DOJ admits liability</u></i>, on the other hand it isn't
much as far as compensation. For a comparison, the fund set up for the
911 victims was substantially higher, in the 2 million range. The $50,000
is hardly enough to pay for many who are having major medical issues.
Chemo and other treatments aren't cheap, I hear from other posters. There is also no word on if there is a
"release of further claims" attached to this bill for illnesses you may
have in the future. For some $50,000 is a good chunk of change, but for some it
barely covers the expenses they have already accrued and continue to with
medical care and medications. It is quite literally a slap in the face to the families of Camp Lejeune.<br /></span></div><div aria-controls=":2ut" aria-label="Message Body" aria-multiline="true" role="textbox" style="direction: ltr; min-height: 291px;"><span style="font-size: medium;">If
you are like me, it's been a long battle over my lifetime to understand
why I was as sick as I am. I now know what caused me all these issues
and taken from me was the ability to have a family and years of
suffering with other illnesses.Thankfully I haven't suffered like my siblings
with rare diseases, and all those suffering in silence, not knowing why they are sick and those
already lost to us. They deserve <i>medical care</i>, and <i>fair</i> <i>compensation</i>
and
frankly if they can pay out 2 million for 911, they can certainly take
care of your medical needs and give you just compensation. Veterans
deserve better treatment than they are given. Their families should not
be forgotten. Where are this nation's
priorities? Use your voice and make those calls and write emails and
letters to your State Senators. It takes very little time to express to
them that what the DOJ has to offer isn't fair compensation for all who
have suffered and died. How many do not even know about the
contamination? Raise awareness wherever you go. There are signs
available at one of the links above. One of the coordinators of the May
19th Awareness Day. They can point you in the right direction at least.</span></div><div aria-controls=":2ut" aria-label="Message Body" aria-multiline="true" role="textbox" style="min-height: 291px;"><span style="font-size: medium;">Get
involved for yourself and your family. Speak up and ask politely for
them to consider a better deal for all of us. Let's get the Pact Act
passed in Congress as soon as possible. The DOJ would just like all of
us to go away. We are, of disease and illness, but not fast enough I
guess. Do not allow them to put out pennies in comparison to what they
shovel out to foreign governments and illegals runamok in our country.
Stand up, shout out and be heard. Thanks much for supporting our cause!

<br />
<br />
Camp Lejeune: Everyone, we finally now have a "bill" that is
scheduled for filing in the U.S. House of Representatives on March 11.
Please do not contact your House Member or Senator until after the Bill
is filed.<br />
Also, if you would like some help or suggestions on how
to make your contact with you Representative more meaningful, please
let us know who you wish to contact and we will go into our data base
and give you some suggestions on that particular Senator or Congressma<span class="text_exposed_show">n.</span><br />
<div class="text_exposed_show">
Now is the time to increase our membership. We need members from all
over the US so that all of the elected officials will be contacted by a
constituent. if you can "share" the information with fellow Marines or
their families to spread the word, it would benefit everyone.<br />
Again, this will work if we all pull together. If you want a copy of
the "Bill" please send me an email and i will send a copy to you right
away.<br />
Thanks<br />
Ed Bell, Bell Legal Group<br />

The Agency for Toxic Substances and Disease Registry (ATSDR) has created
a community assistance panel (CAP) for the Camp Lejeune site. The
purpose of the CAP is to voice the concerns of the affected community of
Marines and their families and to provide input on ATSDR’s public
health activities. Members of the CAP will provide individual input as
